Section 9 of the RERA Act 2016 makes agent registration mandatory across India. Every real estate agent — regardless of experience or transaction size — must register with their state authority before facilitating any transaction.

⚠️ Operating Without RERA Registration is Illegal
Under Section 9(1) of the RERA Act 2016, every real estate agent must register with their state RERA authority before facilitating any transaction. Penalty for operating without registration: ₹10,000 per day — with no upper cap specified. 60 days unregistered = ₹6,00,000 in penalties.

Section 9(1) states: "No real estate agent shall facilitate the sale or purchase or act on behalf of any person to facilitate the sale or purchase of any plot, apartment or building, as the case may be, in a real estate project or otherwise, being sold by the promoter in any planning area without obtaining registration under this section."

Key Principle: Activity Determines Status, Not Title
Whether you call yourself a "consultant," "advisor," "relationship manager," or "marketing executive" — if you introduce buyers to sellers or developers for compensation, you need RERA registration. The law looks at the activity, not the job title.

The General Registration Process

Visit the state RERA portal
Go to your state's official RERA website. All portals have an "Agent Registration" section. Do not use third-party sites claiming to process RERA registrations — always go direct.

Create an account
Register with your mobile number and email. You will receive an OTP for verification. Keep these credentials safe — they are your permanent access to your RERA profile.

Fill the application form
Personal details, address, professional background, nature of business (individual/firm/company). Be accurate — false information in RERA applications is a violation under RERA Section 60.

Upload documents
Scan all documents clearly. File size limits apply (typically 2–5MB per document). Most portals accept PDF and JPG formats.

Pay the registration fee
Online payment through the portal's integrated payment gateway. Keep the payment receipt — you will need it for follow-up if processing is delayed.

Submit and track
Note your application reference number. Most portals have a "Track Application" feature. If no decision within 30 days, registration is deemed granted under Section 9.

Download your certificate
Once approved, download your RERA Registration Certificate. It contains your unique registration number. Memorise it — you need it on every transaction document.

After Registration — Your Obligations

Display your registration number
On all transaction documents, correspondence, and advertisements. It's a legal requirement under Section 9(3).
Maintain records
Books of accounts, client registers, transaction files — subject to RERA authority inspection under Section 26.
Don't facilitate unregistered projects
Section 10(a): never market or sell a project that requires RERA registration but doesn't have it.
Avoid unfair trade practices
Section 10(c): no false statements, misleading information, or failure to issue receipts.
Update details if they change
Business address, contact number, firm structure — update your RERA profile promptly.
Renew before 5 years
Expired registration = same as no registration. Penalty applies from the day of expiry.

Renewal — Every 5 Years

RERA registration expires after 5 years and must be renewed before the expiry date. The renewal process is similar to the original application — updated documents, renewal fee (typically same as or less than original), and fresh self-declaration.

Don't Miss Renewal
Operating on an expired RERA registration is treated identically to operating without registration — ₹10,000/day penalty applies from the day of expiry. Set a calendar reminder 60 days before expiry. Maharashtra additionally requires a current COC for renewal.

5 Common Registration Mistakes

Applying in the wrong state
Registration must be in the state where you facilitate transactions. If you work in both Haryana and Punjab, you need two registrations — one in each state.

Incomplete documents
A missing ITR or unclear scan causes delays. Prepare all documents before starting the application — don't upload piecemeal.

Forgetting renewal
RERA registration does not auto-renew. Set a reminder 60 days before expiry. Many experienced agents have been caught operating on expired registrations.

Skipping Maharashtra COC
Agents in Maharashtra who apply for registration or renewal without completing the COC exam will have their application rejected. COC is a non-negotiable prerequisite since January 2024.

Operating while application is pending
Your registration is only valid when the certificate is issued — not when the application is submitted. During processing, you cannot legally facilitate transactions.
